THE SPLASH COINS GAME PLAY IS NOT “REAL MONEY GAMBLING”. NO ACTUAL MONEY IS REQUIRED TO PLAY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCE OF WINNING. THE SPLASH COINS GAME PLAY IS INTENDED FOR RECREATIONAL AND ENTERTAINMENT PURPOSES ONLY AND IS VOID WHERE PROHIBITED.

THE SPLASH COINS GAME PLAY IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS AND IS VOID WHERE PROHIBITED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED BUT HAVE NOT BEEN MET, OR WHERE THE METHODS OF ENTRY SET FORTH BELOW WOULD BE DEEMED CONSIDERATION. PARTICIPATION IN SPLASH COINS GAME PLAY CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT WITH AND ACCEPTANCE OF THE SPLASH RULES.

THESE SPLASH RULES ARE TO BE READ TOGETHER WITH THE GENERAL TERMS .

THE MINIMUM AMOUNT OF CASH WHICH CAN BE REDEEMED BY USING REDEEMABLE SPLASH COINS IS 100 UNITED STATES DOLLARS. AMOUNTS BELOW THE THRESHOLD ARE NOT ELIGIBLE FOR REDEMPTION.

THESE SPLASH RULES INCORPORATE CLAUSE 20 (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE ON AN INDIVIDUAL BASIS) IN THE GENERAL TERMS, WHICH INCLUDE A PROVISION WAIVING THE RIGHT TO PURSUE ANY CLASS, GROUP OR REPRESENTATIVE CLAIM AND REQUIRING YOU TO PURSUE PAST, PENDING, AND FUTURE DISPUTES BETWEEN YOU AND US THROUGH INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT WITHIN THE SPECIFIED TIME FRAME. PLEASE SEE CLAUSE 9 OF THESE SPLASH RULES FOR FURTHER INFORMATION.

PLEASE NOTE THAT THE GENERAL TERMS INCLUDES A PROVISION WAIVING THE RIGHT TO A JURY TRIAL. FOR FURTHER DETAILS PLEASE SEE CLAUSE 29.1.b) (ADDITIONAL PROVISIONS) IN THE GENERAL TERMS.

YOU MAY ONLY PARTICIPATE IN SPLASH COINS GAME PLAY, IF YOU ARE LOCATED AND RESIDENT IN THE UNITED STATES (EXCEPT IF YOU ARE LOCATED OR RESIDENT IN WASHINGTON STATE, THE STATE OF IDAHO, THE STATE OF NEVADA, THE STATE OF KENTUCKY, THE STATE OF MICHIGAN, THE STATE OF CONNECTICUT, THE STATE OF NEW JERSEY, THE STATE OF MONTANA, THE STATE OF MARYLAND FOR FURTHER DETAILS REGARDING ELIGABILITY PLEASE SEE CLAUSE 2 (ELIGIBILITY QUALIFICATIONS) BELOW.

1. Introduction

1.1 Interactive Studios Inc. is the sole sponsor of the Splash Coins Game Play (“Sponsor“, “Promoter”, “Company“, “we“, “us” or “our“).

1.2 PARTICIPATING IN THE SPLASH COINS GAME PLAY IS YOUR FULL AND UNCONDITIONAL AGREEMENT TO THESE SPLASH RULES, THE GENERAL TERMS AND THE SPONSOR’S DECISIONS, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SPLASH COINS GAME PLAY, INCLUDING BUT NOT LIMITED TO, DECISIONS RELATED TO THE SPLASH COINS, YOUR RECEIPT OF SPLASH COINS, REDEEMABLE SPLASH COINS ELIGIBILITY, WINNERS, THE REDEMPTION OF SPLASH PRIZES AND YOUR COMPLIANCE WITH THE SPLASH RULES AND THE GENERAL TERMS.

1.3 Terms which are defined in the General Terms and which are used in the Splash Rules, shall have the meaning given to them in the General Terms, unless otherwise defined in the Splash Rules

1.4 When you play in Splash Coins Game Play, you may use Splash Coins for the chance to win Redeemable Splash Coins, which will be redeemed for Splash Prizes according to the General Terms and these Splash Rules.

1.5 To participate in Splash Coins Game Play, you must have a Player Account (which is not an Inactive Player Account). If you do not have a Player Account, you can easily create one free of charge though the Platform.

1.6 We reserve the right to add, modify, remove, discontinue or suspend the Splash Coins Game Play at any time, or any part thereof with immediate effect and without prior notice to you. Under no circumstances shall we be held liable to you for any loss, damage or liability suffered by you which results from any addition, modification, removal or suspension of the Splash Coins Game Play, or any part thereof. For the avoidance of doubt, you will have no claims with respect to the addition, modification, removal or suspension of the Splash Coins Game Play.

2. Eligibility Qualifications

2.1 You hereby represent and warrant to us that you are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in the Splash Rules and the General Terms and to fully comply with the Splash Rules and General Terms at all times.

2.2 You must be a natural person who is at least 18 years of age or the age of majority in your jurisdiction, whichever is higher, who:

a) is located within the United States and is not located or resident in any Prohibited Jurisdictions.

“Prohibited Jurisdictions” shall mean (i) any jurisdiction outside of the United States; and (ii) in the United States, the following Washington State, The State of Idaho, The State of Nevada, The State of Kentucky, The State of Michigan, The State of Connecticut, The State of New Jersey, The State of Montana, The State of Maryland.

b) is legally able to enter into binding contracts under applicable law; and
c) can form legally binding contracts under applicable law.

2.3 Any employee, officer, director and former employee, officer and director (less than three years since such person ceased to be an employee, officer or director, as applicable) of any member of the Company Group, any of their respective advertising agencies, service providers or consultants or any other entity or individual involved with the design, production, execution or distribution of the Platform or the Platform Content and their immediate family (spouse, parents, siblings and children, whether the relationship is by birth, marriage or adoption) and household members (persons who share the same residence at for least three months of the year), are not eligible to access the Platform and Platform Content, register a Player Account and participate in the Splash Coins Game Play.

2.4 By participating in the Splash Coins Game Play you warrant and represent to us that you:

a) are a natural person who is located in the United States and you are not located or resident in any of the Prohibited Jurisdictions;
b) are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher;
c) can form legally binding contracts under applicable law;
d)are not listed on any relevant PEP or sanctions lists;
e) are legally allowed to participate in the Splash Coin Game Play; and
f) are eligible in accordance with this Clause ‎2 (Eligibility Qualifications) to participate in the Splash Coins Game Play.
g) are participating in the Splash Coin Game Play for your own behalf and not on the behalf of any other person or entity;
h) are participating in the Splash Coin Game Play in your personal capacity for recreational and entertainment purposes only;
i) are not listed on any U.S. Government list of prohibited or restricted parties; and
j) are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country.

3. How to Obtain Splash Coins

3.1 Following your registration of a Player Account (which is free of charge to create) and subject to your Player Account not being an Inactive Player Account, at our discretion, Splash Coins may be granted to you by us for free, in the following ways:

a) Purchases: You may be granted Splash Coins as a bonus when purchasing specific promotional packs of Gold Coins through the Platform Services.
b) As retention and progression bonuses: You may be granted Splash Coins as a bonus, as a result of completing certain actions as determined by us from time to time in accordance with any terms which we may make available.
c) You may Receive Splash Coins via completing and sending compliant requests by post to us. Subject to Clauses 3.2 and 3.3, you may receive 2 Splash Coins by:

(i) obtaining a Request Code (please see Clause 3.2 below);
(ii) sending a piece of white paper, which must be 4” x 6”, unfolded and unlined (“Request Form“) and placing the Request Form inside a stamped #10 envelope (the “Envelope“); and (iv) fulfilling to our satisfaction all of the requirements detailed below.

You must:

(i) Send the Envelope with the Request Form inside to the following address (the address must be handwritten in black ink in legible handwriting):

(ii) Handwrite in black ink in legible handwriting on the front of the Envelope your return address and the phrase “Request For Splash Coins”.
(iii) Handwrite in black ink in legible handwriting on one side of the Request Form which is placed inside the Envelope:

– The Request Code (only one Request Code may be used per Request Form).
– The return/residential address registered to your Player Account;
– Your full name as shown on your government issued identification and as associated with your Player Account;
– The email address registered to your Player Account;
– The following statement: “I wish to receive Splash Coins to participate in the Splash Coin Gameplay. By submitting this request, I hereby declare that I have read, understood and agree to be bound by Interactive Studios General Terms and Splash Rules.
All Request Forms and Envelopes become the exclusive property of the Sponsor and will not be returned.

3.2 The unique one-time request code comprises a combination of 12 digits (the “Request Code“) which may only be used once by you and expires 30 days after it is displayed through your Player Account. In order to obtain the Request Code, you must: log into your Player Account. This Request Code assists with the accurate and efficient processing of the Request Form.

3.3 Please note the following:

a) Each Envelope must only contain one Request Form with one Request Code.
b) You must ensure that your handwriting is legible. If your handwriting is deemed by us, in our sole discretion, to be illegible, your entry shall be void and the Splash Coins will not be credited to your Player Account.
c) You must not electronically copy or duplicate any Envelope or Request Form.
d) Splash Coins requests must only be made by the individual associated with his/her Player Account. Each Request Code is valid only for use by the individual whose Player Account was used to generate the Request Code. Requests made by any other individual or entity will be declared invalid and the Splash Coins will not be credited to the relevant Player Account.
e) In the event that a dispute regarding the identity of an individual who submitted an Envelope or Request Form is not successfully resolved to our satisfaction, the request in dispute will be deemed void and Splash Coins will not be credited to your Player Account.
f) We are in no way responsible for any Envelope or Request Form that is incomplete, invalid, lost or misdirected.
g) Disqualified Request Forms will not be reconsidered, all of our decisions related to Envelope and Request Form approval are final and no reconsiderations will be allowed.
h) The actual amount of Splash Coins which you may receive may be amended by us at any time, without notice to you.
i) The Envelope must be posted and postmarked from the same State as your residential address associated with your Player Account.
j) Use of any automated or other system to receive Splash Coins is prohibited and if you are in breach of the foregoing we may disqualify you from the Splash Coins Game Play or terminate or suspend your Player Account.
k) Requests determined by us, in our sole discretion, made by any other individual, organization, programme or any entity (including but not limited to commercial sweepstakes subscription, notification, automation or entering services) or those posted from a State which is different to your verified residential address will be declared void and Splash Coins will not be credited to your Player Account.
I) In the event a dispute regarding the identity of the individual who submitted a request or whether a request satisfies the requirements set out above cannot be resolved to our satisfaction, the affected request/entry will be deemed void and no Splash Coins will be credited.
m) We reserve the right, in our sole discretion, to disqualify from the Splash Coins Game Play or terminate or suspend your Player Account if we deem that: (i) you have provided to another person or received from another person a Request Code; or (ii) you have tampered with or attempted to alter the process in which a Request Code is generated.
n) We shall in no way be liable to acknowledge our receipt of the Envelope and Request Form, update you as to either of their status or return them to you.

4. Splash Coins and Splash Prizes

4.1 Splash Coins

a) Splash Coins cannot be purchased.
b) Splash Coins have no monetary value, they cannot be withdrawn or transferred or exchanged.
c) Splash Coins can only be used on Splash Coins Game Play and you may only participate in Splash Coins Game Play, if you possess in your Player Account a sufficient number of Splash Coins for playing the relevant Game in Splash Coins Game Play.
d) The number of Splash Coins required for playing each Game in Splash Coins Game Play is displayed in the applicable Game.
e) The amount of Splash Coins which are credited to you will be displayed in your Player Account.
f) Once you select Splash Coins for use in Splash Coins Game Play and we accept the transaction, you cannot cancel the use of such Splash Coins.
g) We reserve the right to remove, expire, limit, change, manage, regulate, control, modify or eliminate Splash Coins, whether generally or specifically to you and we shall have no liability to you with respect to the exercise of such rights.
h) Splash Coins expire automatically 60 (sixty) days from the date they are granted to your Player Account and will be removed from your Player Account.
i) Splash Coins can be used to play Splash Coin Game Play for a chance to acquire Redeemable Splash Coins. These Redeemable Splash Coins can be used to obtain Splash Prizes.
j) You agree not to transfer, attempt to transfer, assign, attempt to assign, sub-license, attempt to sublicense, sell, attempt to sell, give, attempt to give, trade or attempt to trade, Splash Coins. Any such attempt by you is prohibited and void.

4.2 Splash Prizes

a) Limitations

(i) Splash Coins granted to you cannot be directly redeemed for Splash Prizes. Splash Coins must first be played at least once on the Splash Coins Game Play before Splash Prizes can be obtained by using Redeemable Splash Coins, however, at our discretion, we may require that you use any Splash Coins granted to you be played a greater number of times in any combination of Splash Coins Game Play before Splash Prizes can obtained by using Redeemable Splash Coins (“Play Through Requirements“).
(ii) The minimum amount of cash which can be obtained by redeeming Redeemable Splash Coins is 100 United States Dollars. This amount may be amended at our discretion at any time and without notice to you.
(iii) You agree not to transfer or attempt to transfer (except with respect to redeeming Redeemable Splash Coins for Splash Prizes from the Company), assign, attempt to assign, sub-license, attempt to sublicense, sell, attempt to sell, give, attempt to give, trade or attempt to trade, Redeemable Splash Coins. Any such attempt by you is prohibited and void.
(iv) We may impose limits on the amount of Redeemable Splash Coins you can redeem, per day or to any other amount as determined by us, required by applicable law, regulation or our service providers, as notified to you through the Platform Services.
(v) We reserve the right to remove, expire, limit, change, manage, regulate, control, modify or eliminate Redeemable Splash Coins, whether generally or specifically to you and we shall have no liability to you with respect to the exercise of such rights.
(vi) If you are located or registered in the State of New York or the State of Florida, a cap of 5,000 United States Dollars will apply to any Redeemable Splash Coins won on any one spin, play or equivalent.

b) How to Receive Splash Prizes

(i) Splash Prizes can only be obtained through redeeming Redeemable Splash Coins, which is for the avoidance of doubt subject to Clause 4.2 ‎a).
(ii) Only Redeemable Splash Coins will offer the opportunity to redeem them for Splash Prizes.
(iii) Each Redeemable Splash Coin can be redeemed for Splash Prizes, which is for the avoidance of doubt subject to Clause 4.2 ‎a).
(iv) Upon redeeming the Redeemable Splash Coins to obtain a Splash Prize and our acceptance of this, you cannot cancel the redemption of such Redeemable Splash Coins

c) Cash Redemption:

(i) If you redeem any Redeemable Splash Coins for cash, subject to the Player Agreement, we will pay such amount in USD to the Payment Mechanism. If for any reason we cannot process the payment to the Payment Mechanism we may, at our discretion, pay you via the Substitute Payment Mechanism, which we may select.
(ii) It is solely your responsibility to ensure that the details of the Payment Mechanism or Substitute Payment Mechanism (as applicable) are correct and up to date.
(iii) If the redeemed cash does not reach you due to the details of your Payment Mechanism or Substitute Payment Mechanism (as applicable) not being correct and up to date, we shall not be liable to reverse or re-issue the cash.

d) Redemption of Tangible Splash Prizes:

(i) Tangible Splash Prizes (except for Digital Gift Card) Redemption: Following your redemption of Redeemable Splash Coins for a Tangible Splash Prize, subject to the Player Agreement, we will send the Tangible Splash Prize to the bricks and mortar address associated with your Player Account when you redeem such Splash Prize. If the Tangible Splash Prize is not delivered to you, we shall have no liability to you and for the avoidance of doubt we shall not be liable to provide you with a replacement Tangible Splash Prize.
(ii) Digital Gift Card Redemption: Following your redemption of any Redeemable Splash Coins for a digital gift card, subject to the Player Agreement, we will send the gift card to the email address associated with your Player Account when you choose the gift card. If the gift card is not delivered to you, we shall not be liable to you and for the avoidance of doubt we shall not be liable to provide you with a replacement digital gift card.

e) Additional Redemption Provisions:

(i) Splash Prizes shall not be substituted, assigned or transferred by you. We reserve the right to substitute any of the Splash Prizes with another Splash Prize of greater or equal value.
(ii) It is solely your responsibility to ensure that the email address and bricks and mortar address (as applicable) which is associated with your Player Account is correct and up to date. For the avoidance of doubt, if a Splash Prize does not reach you as the details are not correct and up to date, we shall not be liable to provide you with a replacement Splash Prize.
(iii) PRIOR TO REEDEEMING ANY SPLASH PRIZES, YOU MAY BE REQUIRED BY US TO SUBMIT VIA THE PLATFORM YOUR GOVERNMENTAL ISSUED IDENTIFICATION, YOU MAY ALSO BE REQUIRED TO SEND VIA EMAIL OR VIA THE US POSTAL SYSTEM TO US AN AFFIDAVIT/DECLARATION OF ELIGIBILITY AS PROVIDED BY US, A PUBLICITY/LIABILITY AGREEMENT/RELEASE AS PROVIDED BY US AND APPROPRIATE TAX FORMS, BY A DEADLINE SPECIFIED BY US. FAILURE TO COMPLY WITH THESE REQUIREMENTS (WHICH INCLUDES WITHOUT LIMITATION FAILING TO PROPERLY EXECUTE AND RETURN THE AFFIDAVIT/DECLARATION OF ELIGIBILITY AND THE PUBLICITY/LIABILITY AGREEMENT/RELEASE BY THE DEADLINE OR YOUR FAILURE TO PROPERLY COMPLETE THE TAX FORMS BY THE DEADLINE), AT OUR DISCRETION MAY RESULT IN DISQUALIFICATION AND YOUR FORFEITURE OF THE SPLASH PRIZE AND THE REDEEMABLE SPLASH COINS USED TO REDEEM SUCH SPLASH PRIZE.
(iv) FOR THE AVOIDANCE OF DOUBT PRIOR TO YOUR REDEMPTION OF ANY SPLASH PRIZES, WE RESERVE THE RIGHT TO CONDUCT VERIFICATION CHECKS AS DETAILED IN CLAUSE 6 (VERIFICATION AND CONFIRMATION).
(v) WE SHALL HAVE NO LIABILITY TO YOU WITH RESPECT TO YOUR USE OF ANY SPLASH PRIZES.
(vi) IN THE EVENT THAT YOU REDEEM A TANGIABLE SPLASH PRIZE, ONCE IT LEAVES OUR OR OUR SUPPLIERS PREMISES, WE SHALL HAVE NO FURTHER LIABILITY TO YOU WITH RESPECT OF SUCH TANGIABLE SPLASH PRIZE.
(vii) THERE MAY BE THIRD PARTY TERMS AND CONDITIONS WHICH APPLY TO THE SPLASH PRIZE WHICH YOU HAVE REDEEMED, WHICH INCLUDES WITHOUT LIMITATION AN EXPIRATION DATE. IT IS SOLELY YOUR RESPONSIBILITY TO BE AWARE OF AND COMPLY WITH SUCH THIRD-PARTY TERMS AND CONDITIONS AND WE SHALL HAVE NO LIABILITY TO YOU IF YOU FAIL TO COMPLY WITH SUCH TERMS AND CONDITIONS.
(viii) IF YOU HAVE BEEN ISSUED A SPLASH PRIZE THAT DOES NOT BELONG TO YOU, THE VALUE OF THE MISTAKENLY ISSUED PRIZE WILL (WITHOUT PREJUDICE TO OTHER REMEDIES AND ACTIONS THAT MAY BE AVAILABLE TO US) CONSTITUTE A DEBT OWED BY YOU TO US. IN THE EVENT OF AN INCORRECT CREDITING, YOU ARE OBLIGED TO NOTIFY US BY EMAIL TO: SUPPORT@SPLASHCOINS.COM. WE RESERVE THE RIGHT TO DEDUCT FROM YOUR PLAYER ACCOUNT OR OTHERWISE CHARGE OR ADJUST YOUR PLAYER ACCOUNT TO CORRECT ERRORS.

5. Fees and Taxes

5.1 Fees

a) We reserve the right to charge you processing fees with respect to the receipt of any Splash Prizes or processing of any Splash Prizes.
b) You are solely responsible for any foreign exchange transaction fees, charges, or other related costs which are charged or incurred in relation to payments made to us or by us, including but not limited to any losses or costs arising from foreign exchange fluctuations.

5.2 Taxes

a) Prior to your redemption in aggregate of 600 United States Dollars or more in Redeemable Splash Coins over one calendar year, you must provide an updated address and social security details to us. These details will be used to allow us to comply with tax regulations and may be shared with appropriate tax authorities. If we do not receive such updated address and social security details, we may suspend any redemption of Redeemable Splash Coins which you request, until we have received such information to our satisfaction.
b) All payments made by you to us, and your redemption of any Redeemable Splash Coins for Splash Prizes and Splash Prizes are exclusive of all taxes, duties, levies, charges and similar governmental assessments, including sales taxes, uses tax, value-added taxes, goods and services taxes, excise, business, service, and similar transactional taxes imposed by any jurisdiction and the interest and penalties thereon, excluding taxes based on our net income (collectively “Relevant Taxes”), which you solely shall be responsible to pay.
c) All payments made by us, and the redemption of any Redeemable Splash Coins for Splash Prizes, such shall be inclusive of all Relevant Taxes which you solely shall be responsible to pay. Furthermore, we reserve the right to charge you any Relevant Taxes or charge a fee to offset any Relevant Taxes.
d) In the event that under applicable law, we are required to deduct and withhold any amount from Splash Prizes and to pay over to the relevant tax authorities, any amount on account of Relevant Taxes, any such amount deducted and withheld by the Company shall be deemed paid to you for all purposes hereunder.
e) You confirm to us, that you are not subject to backup withholding tax because:
1. f) you are exempt from backup withholding;
2. g) you have not been notified by the Internal Revenue Service (IRS) that you are subject to backup withholding as a result of a failure to report all interest or dividends; or
h) the IRS has notified you that you are no longer subject to backup withholding. You are solely responsible for filing and paying applicable state and federal taxes, duties, levies or fees on Redeemable Splash Coins and Splash Prizes.

6. Verification and Confirmation

6.1 POTENTIAL WINNERS OF REDEEMABLE SPLASH COINS ARE SUBJECT TO VERIFICATION BY US IN ANY MANNER THAT WE MAY CHOOSE WHICH INCLUDES WITHOUT LIMITATION THE VERIFICATION CHECKS STATED IN CLAUSE 3 (VERIFICATION) OF THE GENERAL TERMS.

6.2 YOU ARE NOT A WINNER OF ANY OF REDEEMABLE SPLASH COINS ON SPLASH COINS GAME PLAY, EVEN IF THE SERVICES INDICATE YOU ARE, UNLESS AND UNTIL YOUR ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED BY US TO OUR SATISFACTION AND WE HAVE ESTABLISHED THAT YOU HAVE FULLY COMPLIED WITH THESE SPLASH RULES AND THE GENERAL TERMS AND YOU HAVE BEEN NOTIFIED BY US THAT VERIFICATION IS COMPLETE. WE WILL NOT ACCEPT ANY PURPORTED EVIDENCE OF WINNING IN LIEU OF OUR VALIDATION PROCESS.

6.3 IF YOU ARE GRANTED REDEEMABLE SPLASH COINS ON SPLASH COINS GAME PLAY, YOU MAY BE REQUIRED BY US TO RETURN VIA THE PLATFORM YOUR GOVERNMENTAL ISSUED IDENTIFICATION, YOU MAY ALSO BE REQUIRED TO SEND VIA EMAIL OR VIA THE US POSTAL SYSTEM AN AFFIDAVIT/DECLARATION OF ELIGIBILITY AS PROVIDED BY US, A PUBLICITY/LIABILITY AGREEMENT/RELEASE AS PROVIDED BY US AND APPROPRIATE TAX FORMS, BY A DEADLINE SPECIFIED BY US. FAILURE TO COMPLY WITH THESE REQUIREMENTS (WHICH INCLUDES WITHOUT LIMITATION FAILING TO PROPERLY EXECUTE AND RETURN THE AFFIDAVIT/DECLARATION OF ELIGIBILITY AND THE PUBLICITY/LIABILITY AGREEMENT/RELEASE BY THE DEADLINE OR YOUR FAILURE TO PROPERLY COMPLETE THE TAX FORMS BY THE DEADLINE), AT OUR DISCRETION MAY RESULT IN DISQUALIFICATION AND YOUR FORFEITURE OF THE REDEEMABLE SPLASH COINS.

6.4 IF YOU ARE A TENTATIVE WINNER AND CANNOT BE CONTACTED BY US (INCLUDING WITHOUT LIMITATION IF THE SPASH PRIZE OR SPASH PRIZE NOTIFICATION IS RETURNED TO US AS UNDELIVERABLE), OR YOU FAIL TO COMPLY WITH THESE SPLASH RULES OR GENERAL TERMS OR YOU CANNOT BE VERIFIED BY US IN A TIMELY MANNER, YOU MAY AT OUR DISCRETION BE DISQUALIFIED, IN WHICH CASE YOU WILL FORFEIT AND HAVE NO RIGHT TO THE SPLASH PRIZE.

7. Release

By playing the Splash Coins Game Play, you agree to release and hold harmless each member of the Company Group and each of their respective officers, directors, employees, shareholders, stockholders, agents, partners, licensors, subcontractors, suppliers and any entity responsible for sponsoring, fulfilling, administering, advertising, or promoting Splash Coins Game Play (collectively the “Discharged Parties“) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to the Envelope or the Request Form.

8. Additional Limitations of Liability

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

8.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES WHATSOEVER WILL THE DISCHARGED PARTIES, BE RESPONSIBLE FOR:

8.2.1 ANY INCORRECT OR INACCURATE INFORMATION PROVIDED, WHETHER CAUSED BY YOU OR CAUSED BY A PRINTING ERROR OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE SPLASH COINS GAME PLAY;
8.2.2 ANY INCORRECT OR INACCURATE INFORMATION PROVIDED WITH RESPECT TO ANY REQUEST FORM OR ENVELOPE INCLUDING BUT NOT LIMITED TO IF CAUSED BY YOU OR FOR ANY FAULTY OR FAILED ELECTRONIC DATA TRANSMISSIONS OR PRINTING ERROR;
8.2.3 TECHNICAL FAILURES OF ANY KIND, IN RESPECT OF THE OPERATION OR ADMINISTRATION OF SPLASH COINS GAME PLAY;
8.2.4 ANY UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE REQUEST FORM, ENVELOPE, OR THE SPLASH COINS GAME PLAY;
8.2.5 ANY UNAUTHORIZED ACCESS TO, OR THEFT, DESTRUCTION, OR ALTERATION, OF REQUESTS FOR SPLASH COINS;
8.2.6 INACCESSIBILITY OR UNAVAILABILITY OF ANY NETWORK OR WIRELESS SERVICE, THE INTERNET OR WEBSITE OR ANY COMBINATION THEREOF;
8.2.7 ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY (IN WHOLE OR IN PART) BE RELATED TO OR RESULTING FROM YOUR PARTICIPATION IN SPLASH COINS GAME PLAY OR THE DOWNLOAD OF ANY MATERIALS RELATED TO SPLASH COINS GAME PLAY;
8.2.8 ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY (IN WHOLE OR IN PART) BE RELATED TO OR RESULTING FROM THE RECEIPT, USE OR MISUSE OF ANY SPLASH PRIZE; OR
8.2.9 ANY TECHNICAL MALFUNCTION, INTERRUPTION FAILURE OR ERROR, INCLUDING WITHOUT LIMITATION ANY DISCONNECTION DELAY, INTERRUPTION OR DEFECT IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE.

8.3 IF FOR ANY REASON YOUR SPLASH COINS OR REDEEMABLE SPLASH COINS IS CONFIRMED BY US TO HAVE BEEN ERRONEOUSLY DELETED, LOST OR OTHERWISE DESTROYED OR CORRUPTED, YOUR SOLE REMEDY IS REPLACEMENT BY SPONSOR OF AN EQUIVALENT AMOUNT OF SPLASH COINS OR REDEEMABLE SPLASH COINS (AS APPLICABLE).

9. Winners List

9.1 For a list of winners with respect to any one spin, play or equivalent on Splash Coins Game Play, you may submit a request within a year of that date, by sending a self-addressed, stamped envelope stating “I am formally requesting the list of Splash winners from the following Splash Coins Game Play” along with the month, day, and year of the date, entry fee, and prize offered to:

10. Disputes

FOR THE AVOIDANCE OF DOUBT, CLAUSE 20 OF THE GENERAL TERMS (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATION ON AN INDIVIDUAL BASIS) IS INCORPORATED HEREIN BY REFERENCE WITH THE SAME FORCE AND EFFECT AS THOUGH FULLY SET FORTH HEREIN. BY AGREEING TO THESE SPLASH RULES, YOU AGREE TO BE BOUND BY THE DISPUTE RESOLUTION AND ARBITRATION PROVISIONS CONTAINED IN CLAUSE 20 OF THE GENERAL TERMS (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATION ON AN INDIVIDUAL BASIS).

12. Additional Provisions

12.1 ANY ATTEMPT TO DELIBERATELY DAMAGE THE SPLASH COINS GAME PLAY OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SPLASH COINS GAME PLAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

12.2 We may disqualify any person or terminate or suspend the Player Account of any person, we determine has tampered or has attempted to tamper with the entry process (which includes without limitation with respect to the process of generating of the Request Code) or the operation of Splash Coins Game Play or has acted in breach of these Splash Rules, or any other promotion or in an unsportsmanlike or disruptive manner.

12.3 In the event that we terminate your Player Account under these Splash Rules, Clauses 25.5 (b) – 25.5(f) (inclusive) (Player Account Termination and Suspension) in the General Terms shall apply and in the event, we suspend your Player Account under these Splash Rules, Clauses 25.4 in the General Terms shall apply (Player Account Termination and Suspension).
